This privacy policy explains how Aira, i.e. the Swedish entity Aira Group AB (reg. no. 559352-3649), and its European subsidiaries (“Aira”, “we”, “our”, “us”) collect, process, and share your personal data when you visit our website, have general communication with us, use our products and services, or when we process your data in any other way.

Data Controller

The parent company of Aira, the Swedish entity Aira Group AB, is the controller for the processing of personal data related to our websites, online services (such as our mobile applications, heat pump, devices, and other devices sold and market by Aira) and general marketing activities.

The data controller for the processing of your personal data in connection with the prospecting and purchase of heat pumps and other products is the local Aira group company with which you engage in connection with such prospection and purchase. The local Aira group companies may also act as data controller of your data in the context of certain local marketing activities. Note that local data may be shared with centralized technology teams in Aira Group AB for quality assurance and product development purposes.

How we collect your personal data


When you visit our website

When you visit our website, we may collect and process certain personal data through cookies. Data you actively provide

We collect personal data that you actively provide to us when you communicate with us, such as your name, phone number, and email address. I certain situations we may also record phone calls with you.

If you choose to buy or products and services from us, we will ask you provide further details that are necessary such as home address (including postal code and geographic coordinates), date of birth or age, billing information and additional information that may be required for delivery. We may also ask for additional information that may be necessary to handle customer support matters. If you chose to participate in different surveys, we may ask you to provide additional information associated with your use and perception of our products and services.

If you are using our app for remote management of our products (“Aira App”), you will have to provide personal credentials (password etc.) that will be associated with your user account.

Data collected from third parties

If your purchase of products or services is coupled with any form of credit or financing arrangement, we may need to obtain information about you from credit rating agencies.

Automatically collected data

We endeavour to deliver an intelligent home energy expetience. To do this w emay automatically gather device log data from associated with your use of the Aira product (“Device Data”), such as information about your use preferences (e.g. requested temperature changes and energy modes), information about device usage, such as flow of hot water, temperature of hot water, heat pump compressor speeds, energy consumption, energy stored, home environment (e.g. indoor and outdoor temperature), the location of your device, and product components and state of installed software.

When you visit our website, we may collect and process certain personal data through cookies. When you contact us in general matters

The data we may process is your name, email address, phone number, and other data you provide us and may be needed to handle your enquiry. We process this data to be able to communicate with you in general matters regarding our products and services.

When prospecting for our products and services

When you enter a request for further quotation or heating solution details through our digital channels, we might combine the information about your current heating solution and home with data available in public data repositories to improve the precision of our proposed solutions to you. Furthermore, our technical design process to tailor our products to your home requires high precision data from on-site surveys by our technical experts. When we prospect for our products, the on-site surveys generate data, including 3D scan of the interior of your home using a LiDAR-enabled camera, including dimensions and layout of home, location of key systems (e.g. radiators), and other necessary data about your home required to calculate thermodynamic qualities and heat loss. Our home energy optimization systems may also use prospecting-related data to aid in precisely adapting to your local climate and environment.

When you purchase products and services from us

If you purchase products and services from us, we will process your name, contact information, address needed for shipping, payment data and billing data (both one-time and recurring), and other and purchase related data (such as products and services purchased). We use this data to fulfill the agreement we have with you.  

We also process purchase related data to fulfill our legal obligations (e.g. for accounting purposes or fulfilling our obligations to you as a consumer).We may also process your identity data and purchase related data if you communicate with us in customer support matters.  

If you participate in voluntary surveys or testing programs, such additional information may also be processed.

Finally, we may also process your data for marketing purposes, for among others to create segments, focus groups or to send you targeted advertising on social media and digital ad spaces. Please note that if you no longer want to receive marketing from us, you can notify us at any time at privacy@airahome.com.

When you use the Aira products

Besides your basic Aira account data (name, contact details and account credentials), Device Data (as defined above) will be processed to ensure the proper function of your Aira product. Device Data may also be used for troubleshooting your product and enable us to develop and offer improved Aira products and services.

Security etc.

Our online interactions with you, such as relating to the purchase or support of our products and services and your use of the Aira App, require us to take security measures to protect you and ourselves. This processing activities predominantly relates to on-line purchases data and device specific data (such as IP-addresses). We may also record phone calls for training, quality assurance and maintain audit trails.

Other legal obligations

Your participation in certain electricity market initiatives may require us to process certain additional data about you. We may also be required to process certain data about you according to other specific legal requirements. Any such processing will be limited to what is required by the respective regulations.

 

Legal basis for our processing of your data

The legal basis for processing your personal data depends on the type of cookie through which the data has been obtained. Our use of essential cookies is based on our legitimate interest in providing a functional website. Our use of other cookies requires your consent (which you may withdraw at any time), which is also our legal basis for such use. When you contact us in general matters

When we process your name, email address, phone number or home address to be able to communicate to you in general matters, the processing of your data is based on our legitimate interest to be able to carry out such communication.

When prospecting for our products and services

The prospecting phase, which is based on on-site data in your home, includes presenting a commercial offer for efficient and sustainable products and services. The processing of your data in the prospecting phase is our legitimate interest to provide you with an offer for suitable products and services.

When you purchase products and services from us

The legal basis for processing purchases related data is to fulfill our contractual obligations towards you. In addition, we may also need to process your data to ensure that we meet your legal right to complain about a product, which means that the legal basis for such processing is legal obligations.  

If you communicate with us in a support matter, the legal basis may also be our legitimate interest in providing appropriate support to our customers (unless our support relates to our contractual obligation to provide support and maintenance or our legal obligation to handle complaints). We also process financial data to fulfil our legal obligations to maintain accurate accounts. Finally, we may also use your data for our legitimate interest in providing information about our products and services as well as marketing.

When you use Aira devices

The legal basis for processing your basic Aira account data is the contract between you and us. The contract between us is also the legal basis for processing the data that is needed to fulfill our contractual obligations relating to maintenance and support.  

The Device Data (as defined above) may also be used for our legitimate interests of troubleshooting and to provide general support to you. Finally, we may use certain Device Data for our legitimate interest in improving our products and services.

To the extent it is deemed necessary for the establishment, exercise or defense of legal claims or complaints, your data may be processed for such purposes. The legal basis for such processing is our legitimate interest to establish, defend or defense legal claims.

Other legal obligations

To the extent that we are legally required to process your data, e.g. under an electricity market initiative, the legal basis for our processing will be our legal obligation to comply with the respective regulatory requirements.

 

How long we keep your data

When you contact us in general matters

When we communicate with you in a general matter, we delete the data associated with the communication within 1 year of when the matter has been closed.

When prospecting for our products

Personal data collected by us during the prospecting phase is retained for up to 3 years after you are no longer a customer of ours or, if you choose not to purchase a prospected product, for up to 1 year after the prospecting event.

When you purchase our products

We keep data on your purchases for up to 3 years from the date of the respective purchase, provided however that if your purchase also includes support and maintenance, we keep your data for up to 1 year after our maintenance commitment has ended. Accounting data will be kept for as long as required by law (which in many jurisdictions is 7 years).

If you contact us in a customer support matter, we will keep your data for up to 1 year after the matter is resolved, unless we need to keep the data longer to keep accurate audit trail records.

When you use Aira App and Aira devices

We will retain your Aira account data if you are registered with an Aira account or device plus a period of up to 3 years after the account has been terminated and all our obligations under the Aira App agreement between you and us have been fulfilled.

Device Data (as defined above) is retained for a period of up to 5 years from the time of its collection.  

Voice recordings

Voice recordings are maintained for up to 1 month after the respective recording is made.

Legal claims etc.

Please note that your data may be processed beyond the retention periods set out above, if retaining the data is deemed necessary for the establishment, exercise or defense of legal claims or complaints before a court or other authority. If that is the case, the personal data in question will be deleted immediately once such a claim or complaint has become final.

Other legal obligations

Data that we may be legally obliged to keep will be retained in accordance with the respective regulations.

 

With whom do we share your data?

Generally, we do not disclose your personal data to anyone outside the Aira group of companies. However, in some situations we may need to share your data with others. When this happens, no more of your data is shared than is necessary for the respective purpose for it is shared. We share your data with the following categories of recipients:

  • Payment services providers: to facilitate your payment for products and services, payments related data may need to be shared with our payment services providers.
  • Credit rating agencies: to facilitate credit or financing solutions to you, it may be necessary to share your basic identity data with credit rating agencies.
  • Logistic partners: we may need to share some basic information (such as name, contact details and tracking number) with our logistics partners if we need to transport and/or repair a product that you have purchased from us.
  • Energy market initiatives: it may be necessary to share your data with third party partners that work with Aira to engage in energy market initiatives in which you have chosen to participate.
  • Authorities: we may share your data with authorities if needed to respond to valid legal processes, such as warrants, court orders or subpoenas or if deemed necessary for the establishment, exercise or defense of legal claims or complaints.
  • Mergers and acquisitions: we may share your data to prospective purchasers of our business in case we sell or negotiate to sell our business; we will always inform you before a transfer of your data is carried out to a buyer or becomes subject to a different privacy policy.

In addition to the above, your data may be shared with subcontractors, so-called data processors, such as cloud providers and third-party providers of IT systems and solutions. Our data processors are only authorized to process the personal data they receive from us on our behalf and in strict compliance with our instructions, and they are all subject to confidentiality undertakings.

 

Where do we process your data?

We always aim to process your personal data within the EU/EEA. However, in certain situations, such as when we share your information with, for example, an IT provider with operations outside the EU/EEA, your personal data may be processed outside the EU/EEA. If and when your data is processed outside the EU/EEA, we will ensure that there is an adequate level of protection and that appropriate safeguards are in place (for example, through the use of the European Commission's standard contractual clauses or to recipients that has signed up to the EU-U.S. Data Privacy Framework).  

 

Your rights as a data subject

As a data subject, you have certain rights in relation to the processing of your personal data. If you wish to exercise any of them, please contact us via privacy@airahome.com.

  • Right of access: you have the right to obtain information about what personal data we process about you, including the purpose of the processing and the legal basis for the processing.
  • Right to rectification: if you believe that we are processing inaccurate personal data about you, you can ask us to rectify it.
  • Right to restriction of processing: you can request that we restrict the processing of your personal data. This may be relevant, for example, if we have inaccurate data about you and you do not want the processing to continue until we have corrected the data.
  • Right to erasure / right to be forgotten: you can request that we delete your personal data. While we will comply with such a request to the extent required by applicable law, please note that despite your request, we may continue to process certain data (such as data that we need to retain to protect our legal interests or that we are required to retain by law).
  • Right to object: in connection with the processing of personal data based on legitimate interest, you have the right to object to the use of your personal data. If your privacy interests outweigh our interests in processing certain data, we will stop processing such data.
  • Right to data portability: you may also have the right to access the personal data you have provided to us in a structured, commonly accepted, and machine-readable format, as well as the right to transfer the data to another data controller.
